Early-access preview. Bright Spark AI is currently offered free of charge to a limited group of invited testers to gauge market interest and gather feedback. By using the service you accept these terms in full. If you do not agree, please do not use the service.
1. Who we are
Bright Spark AI ("Bright Spark", "we", "us", "our") is operated by Paul Monahan (Founder), based in Jersey, Channel Islands. You can contact us at paul@brightsparktutor.com or via www.brightsparktutor.com.
2. Nature of the service
Bright Spark is a market-test preview of an AI tutoring concept, a free Learn to Read course, and an early view of a future marketplace of independent human tutors. The service is provided free of charge, on an "as is" and "as available" basis, with no warranties of any kind, express or implied. We may change, suspend, restrict or withdraw any part of the service at any time, without notice and without liability.
3. Eligibility & accounts
The AI tutor preview is intended for secondary school students (ages 11+). Users under 18 must have permission from a parent or guardian, who is responsible for their use of the service. The free Learn to Read course can be used without an account.
4. Acceptable use
- Do not use Bright Spark to cheat on supervised exams or coursework.
- Do not attempt to extract, scrape, reverse engineer or resell our content or models.
- Do not submit content that is unlawful, harmful, abusive, or infringes any third-party rights.
- Do not attempt to bypass our safety, child-protection or content controls.
We may suspend or terminate access at our sole discretion, without notice or refund.
5. AI limitations — no reliance
Our AI tutor is an experimental tool that can produce inaccurate, incomplete or misleading information. You must not rely on its output for academic, medical, legal, financial, safety-critical or any other consequential decisions. Always verify important information with a qualified person and your official course materials. We make no guarantee of academic outcomes, exam results or fitness for any particular purpose.
6. Human tutors (when available)
Any human tutors listed on the platform are independent contractors, not employees or agents of Bright Spark. We do not provide tutoring ourselves and are not a party to any arrangement between a tutor and a learner. We are not responsible for the conduct, content, quality, safety or outcomes of any lesson.
7. Intellectual property
All Bright Spark branding, software, content and materials are owned by us or our licensors. You receive a limited, revocable, non-transferable licence to use the service for personal, non-commercial learning during the preview period only.
8. Disclaimers
To the fullest extent permitted by law, we disclaim all warranties, conditions and representations of any kind, whether express, implied or statutory, including (without limitation) warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, availability, non-infringement, and that the service will be secure, uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, and given that the service is provided free of charge:
- We (including the Founder, and any contributors, contractors or suppliers) shall have no liability whatsoever to you or any third party for any loss or damage of any kind arising out of or in connection with your use of, or inability to use, the service.
- This includes, without limitation, any direct, indirect, incidental, special, consequential, punitive or exemplary damages; loss of profits, revenue, goodwill, data, opportunity, academic results, examination performance, or anticipated savings; and any damages resulting from reliance on AI-generated content.
- Our total aggregate liability to you for all claims arising from or related to the service is limited to £100 (one hundred pounds sterling).
- Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or fraud or fraudulent misrepresentation.
10. Indemnity
You agree to indemnify and hold harmless Bright Spark and the Founder against any claims, losses, damages, liabilities and expenses (including reasonable legal fees) arising from your breach of these terms or your misuse of the service.
11. Privacy
Your use of the service is also governed by our Privacy Policy and Cookie Policy.
12. Changes
We may update these terms at any time. Continued use of the service after changes are posted constitutes acceptance of the updated terms.
13. Governing law & jurisdiction
These terms and any dispute or claim arising out of or in connection with them are governed by the laws of Jersey, Channel Islands. The courts of Jersey shall have exclusive jurisdiction, save that we may bring proceedings in any jurisdiction where you reside or where a breach has occurred.
